Statute of Limitations Overview

Criminal SOL

Wyoming has no criminal statute of limitations for any felony charges, which automatically covers all felony sexual assault crimes. Wyoming is among the five states (along with Kentucky, Maryland, North Carolina, and South Carolina) with no criminal SOL for any felony. All felony sex offenses can be prosecuted in Wyoming at any time with no deadline.

Civil SOL

Child survivors: Survivors of childhood sexual abuse must file civil claims within 8 years of the victim reaching age 18 (until age 26) OR within 3 years after the date of discovery that the abuse caused injury, whichever is later. This gives child survivors until age 26 under the standard rule, with the discovery rule providing extension for delayed discovery.

Adult survivors: 4 years from the date of the incident. This is more generous than many states’ 2-year adult deadlines.

Institutional Liability

Important Context

Age-26 deadline is one of the nation’s most restrictive. Wyoming’s 8-years-after-majority cap (age 26) gives child survivors far less time than the national trend. Survivors approaching 26 must consult an attorney immediately. The discovery rule (3 years from discovering the injury’s causal connection to abuse) may provide the only avenue for survivors who are over 26.
